Hafeez Sheikh reviews the proposals of the Tax Reforms Coordination Group

The Tax Reforms Coordination Group (TRCG) met in FBR today, under the chairmanship of Federal Minister for Finance Dr. Abdul Hafeez Sheikh.
Chairman FBR Mr. Mumtaz Haider Rizvi, in his opening remarks informed the Minister about the discussions so far held between the TRCG and FBR. Exclusive discussions on policies and strategies to improve the tax policy with a view to increase the revenue were held alongwith presentations by FBR. Budget proposals for the upcoming budget to be presented in May 2012 were extensively discussed and strategized.
The Federal Minister for Finance stressed the need of increasing the momentum of revenue collection to achieve the current target of Rs. 1952 billion. He appreciated the efforts of FBR where the Provisional Collection upto April was about Rs. 1424 billion and still counting against last year’s collection for the same period at Rs 1150 billion. He expressed confidence and hope that the assigned budget targets would be achieved through sustained efforts. He desired that the detailed collection under various heads be sent to him on daily basis. The day-long meeting continued till late evening.
The meeting was attended by Deputy Chairman Planning Commission Dr. Nadeem ul Haque, Federal Secretary Finance Mr. Abdul Wajid Rana, Secretary EAD Dr. Waqar Masood, DG (ERU) Dr. Khaqan Najeeb and Members TRCG Mr. Irfan Nadeem, Mr. Arshad Zuberi, Mr. Bashir Ali Mohammad, Mr. Shabbar Zaidi and Mr. Ali Jameel alongwith FBR members Ms. Riffat Shaheen Qazi Member (FATE), Mr. Shahid Hussain Asad Member (IR), Sardar Amimullah Khan Member (Enforcement & WHT), Mr. Raza Baqir Member (Admin), Mrs. Azra Mujtaba Member (SP&S) and Mr. Nisar Muhammad Chief Collector (North) FBR.
The Tax Reforms Coordination Group crystallized the current proposals on the forthcoming budget, with the objective to facilitate business, reduce cost of doing the business, avoid economic burden, harmonize tax laws and promote industry and commerce while mproving tax collection.

SECP granted licences to 10 non-profit associations in 3 months

The SECP granted licences to 10 non-profit associations under Section 42 of the Companies Ordinance, 1984, from January to March.

Of the 10 licences, 3 associations each were granted licences in the social services and healthcare sector, 2 each in art and education sector.

In the social services sector, Wishes Foundation intends to develop the rural areas, while CNFA Pakistan Center for Enterprise and Development has been established to work for economic development of the under-privileged classes of the society and Institute of Development and Economic Alternatives has been formed to promote and manage policy research and advocacy for the socio-economic development.

In the healthcare sector, Federal Liver Transplant Endowment Fund having Capital Administration and Development Division (CA&DD), Cabinet Secretariat, as its promoter has been formed to promote liver transplant facilities and to provide financial support to needy patients for liver transplant at the Pakistan Institute of Medical Sciences (PIMS) Islamabad.

The Asian Society of Neurological Surgeons has been set up to promote science and practice in the field of neurological surgery and care.

Pashuma Health Foundation has been formed to aid and run thalassemia hospitals, and other centers connected with the care of the human body, both in urban and rural areas of Pakistan.

In the arts sector, an association namely Institute for Preservation of Art and Culture has been established to conduct research and training in the field of Art and Culture and to support, and encourage projects concerned or dealing with the preservation and reuse of architectural structures and sites in Pakistan. Another association in the same field namely Pakistan Furniture Council has been formed to promote and assist the art, craft and practice of furniture designing.

In the education sector, the Institute of Internal Auditors–Pakistan is formed to promote the professional activities related to the field of internal auditing and 4 Children Community Initiative has been established to establish and promote educational institutions, centres, schools, and other institutions but not to act as a degree awarding institute.

The new associations are expected to play their due role in their respective fields.

Day of mourning: Seven killed in Karachi violence

At least three more people were killed in the recent violence unleashed this morning in the wake of killing of MQM’s worker in the metropolis, pushing today’s overall death toll to seven.

The violent and sabotage elements are currently running amok in the metropolis, bringing the routine civic life to an abrupt halt amid panic large writ on the faces of citizens, media reported on Tuesday. Three more persons were killed in a firing incident in Manzoor Colony in the recent spate of violence this morning. Also, another person was injured in firing incident in Safoora Chowrangi. Meantime, there are reports of injuries to other people as well in other parts of the city. Over 20 buses have been set on fire in different areas of the city.

Some people tried to set a bus on fire near Central Jail; however, their attempt was aborted. Also, firing incidents are being reported from various areas of the city. Gunshots rang in Malir-15 and on National Highway, where two buses were committed to flames. A bus was set on fire in Abul Hasan Isfahani Road area. Some unidentified miscreants set a bus near Jauhar Chowrangi. Some people forced the closure of shops in Gulbahar, where firing incident was also reported. As many as four buses were torched in Orangi Town. Another bus was burned down on Shaheed-e-Millat Road. A mini-bus has been set ablaze at 4K Chowrangi.

Two buses were set on fire near Liaquatabad-10. Some unidentified people roamed around in Gulshan-e-Iqbal-13D, where shops have been shut down in panic. Meantime, there are reports from most areas of the city that petrol pumps have been closed. Intense firing was reported from area abutting Falak Naz Apartments. Police directed citizens to take alternative path to drive their way to their respective destinations. Massive gridlock was also witnessed on Shahra-e-Faisal road leading to airport. (The Nation)

Mqm stages protest against bhatta mafia

Muttahida Qaumi Movement (MQM) lawmakers protested inside the Sindh Assembly while a large number of it’s workers, supporters and traders protested outside against extortion and Parchi Mafia.The MQM legislators chanted slogans against extortion inside the provincial. Later, they marched out after the lights were switched off.MQM MPAs were holding placards inscribed with slogans against extortion and asking Sindh Chief Minister to take notice of the ituation.President of Small Traders Association Ateeq Mir and Leaders of others traders organisation including Electronic Market Association, Jewellers, F.B Area Industrial ssociation, Korangi Association of Trade and Industries, SITE Association and other traders also attended the protest. They appreciated peaceful struggle of MQM against extortion in Karachi. Members of Central Coordination Committee of MQM Wasim Aftab, Dr. Saghir, Raza Haroon and Deputy Parliamentary leader of MQM in Sindh Assembly and provincial minister Faisal Sabzwari addressed the protest and strongly condemn extortions in Karachi and express solidarity

18 nomination papers for senate elections rejected by ECP

The ECP issued the list of all candidates contesting elections to the senate after the scrutiny process, held on 16th & 17th February, 2012. There were 166 candidates against 54 seats in the Senate. Citizen Journalism Grows in Pakistan

With internet usage on the rise, Pakistanis are turning to the blogosphere and citizen journalism to share their opinions. Hosh Media epitomizes the growing popularity of locally-based, online portals for citizen journalism in Pakistan.

According to the Pakistan Telecommunication Authority (PTA), the number of broadband internet subscribers rose from 26,611 in 2005 to 1,656,800 in September 2011; an increase of 1.5 million subscribers. It is also estimated that as of 2011, Pakistan’s population stands at approximately 187 million; of this, the internet penetration is estimated at over 20 million.

Given the proliferation of internet usage in Pakistan, local citizen journalism portals have also seen a rise in popularity. SeenReport, Gawaahi, Maati TV, and other blogs and websites initiated by local media outlets and independent journalists/bloggers have given Pakistanis with access to the internet the chance to have their voices heard.

Hosh Media, though, has a specific focus as a citizen journalism portal. ‘Hosh’ is an Urdu word that loosely translated means ‘to awaken,’ and that is precisely what it hopes to do. By connecting the blogosphere and traditional reporting in Pakistan, founder and Pakistani journalist, Sahar Habib Ghazi, wanted to create a fresh way to engage the public while infusing news with youthful perspectives and voices.

Ghazi credits her time at Stanford University in California as a John S. Knight Journalism Fellow in 2010 for inspiring her to launch this citizen journalism initiative for Pakistanis.

“I came to Stanford with a proposal that aimed at countering the breaking news oriented tilt of our TV newsrooms,” Ghazi explained. “But the fellowship program exposed me to many exciting narratives on the digital and social media front. Within a few months, I was hooked. I decided I needed to bridge the divide between my people – journalists – and online communities – bloggers, activists and tweeters – in Pakistan. Stanford proved to be the perfect incubator for turning that concept into Hosh.”

While at Stanford, Ghazi met Syed Ali Abbas Zaidi and Shahid Saeed via blogging and tweeting. These two young Pakistanis proved to be vital to Hosh Media’s founding in May 2011, as well as its subsequent development.

Primarily known for his social activism in Pakistan, Zaidi is the portal’s Community Lead, while Saeed, a blogger, helped Ghazi establish the portal’s basic set-up. Saeed now works as an Archivist for Hosh along with Technical Lead Haleema Mehmood, Marketing Lead Farhan Kamal, and Operations Lead Nadia Zaffar.  All 5 employees comprise of the initiative’s core team of young Pakistanis.

“Our contributors – bloggers, students and activists – can now log onto hoshmedia.org and send in their videos, images and thoughts. Our team packages these crowd-sourced contributions into news stories for mainstream networks in Pakistan,” Ghazi stated in a Knight Fellowship talk.

The role of citizen journalism in Pakistan today is “essential,” according to Ghazi. “The more voices straight from the ground,” she said, “the more representative and democratic our media will be.”

Hosh Media recently added six online journalism tutorials to its website which are short, interesting, well-packaged videos featuring veteran Pakistani journalist Abbas Nasir highlighting important subjects within journalism such as, “Covering Survivors of Abuse,” “Quoting Anonymous Sources,” and “News vs. Opinion,” among other topics. These tutorials serve as a reservoir of information and articulate instruction for budding citizen journalists and bloggers.

“Our larger goal is to make media in Pakistan more representative of the majority of Pakistan – the youth,” said Ghazi. “Two in three Pakistanis have yet to celebrate their thirtieth birthday; we are overwhelmingly a young country, and we believe these young voices need to be on the mainstream media.”

Hosh Media’s content is quickly gaining attention after its first digital article, “The Youth Speaks” was published on the website of the well-known Pakistani daily newspaper DAWN. The piece focused on youth reaction to the death of Osama bin Laden with crowd-sourced videos and text, according to Ghazi.

In response to that criticism citizen journalism lacks of objectivity, Ghazi argues that broadcast journalism in Pakistan can be biased too. “Our goal at Hosh is to take not one citizen report, but many crowd-sourced reports, curate and edit them into an objective, balanced news piece,” Ghazi said. “Take our story ‘The Youth Speaks,’ for example. It starts with a video featuring three individuals saying they don’t believe Osama bin Laden was in Pakistan, followed by another video featuring three individuals critiquing the army and the government’s role in the bin Laden affair. Balance is essential, and that is the value our editorial team adds to our crowd-sourced citizen reports.”

SC dismissed PM Gilani’s intra court appeal

An eight member bench headed by the Hon’ble Mr. Justice Iftikhar Muhammad Chaudhry, Chief Justice of Pakistan and comprising of other seven Hon’ble Judges namely Mr. Justice Shakirullah Jan,  Hon’ble Mr. Justice Jawwad S. Khawaja, Hon’ble Mr. Justice Anwar Zaheer Jamali, Hon’ble Mr. Justice Khilji Arif Hussain, Hon’ble Mr. Justice Tariq Parvez, Hon’ble Mr. Justice Mian Saqib Nisar and Hon’ble Mr. Justice Amir Hani Muslim heard Intra Court Appeal No. 01/2012, (Against order dated 02.02.2012 Syed Yousaf Raza Gillani, the Prime Minister of Pakistan Vs. Assistant Registrar of Supreme Court).

Mr. Aitzaz Ahsan, Sr. ASC appeared on behalf of the appellant. The bench heard the case and passed following order:-

“This appeal under section 19 of the Contempt of Court Ordinance, 2003 (hereinafter referred to as the Ordinance, 2003) has been preferred on behalf of appellant Syed Yousaf Raza Gillani, incumbent Prime Minister of Pakistan/Chief Executive under the mandate of the Constitution of the Islamic Republic of Pakistan against order dated  02.02.2012 in   pursuance  whereof,  a     7-member Bench of this Court had summoned the appellant for framing of charge of contempt of Court against him. Earlier to this order a show cause notice had been issued to him under section 17(1) of the Ordinance, 2003 whereby he was called upon to show cause as to why contempt proceedings be not taken against him for not complying with the direction of this Court.

2.                     To recapitulate the facts of the case with background, it is to be noted that this Court in its judgment in the Sindh High Court Bar Association case (PLD 2009 SC 879) declared the actions of 3rd November, 2007 of the then President General Pervez Musharraf, and also the permanency granted to certain legislative instruments, including the National Reconciliation Ordinance, 2007 (hereinafter referred to as the NRO, 2007), to be unconstitutional, illegal, mala fide and void ab initio. However, directions were issued to the concerned authorities for placing such legislative instruments before the Parliament. Admittedly, the Parliament did not make NRO, 2007 as an Act. Subsequent thereto, in the Dr. Mobashir Hassan’s case (PLD 2010 SC 265), the provisions of the NRO 2007 were declared to be void ab initio, being ultra vires and violative of the Constitution, and to be deemed to be non est from its inception and directions were issued to revive all the previous/pending proceedings within and outside the country for the detailed reasons mentioned therein.

3.                     It may not be out of context to mention here that after the promulgation of the NRO, 2007, Malik Muhammad Qayyum, the then Attorney General for Pakistan communicated/ addressed letters to various foreign fora/authorities/courts for withdrawing the requests earlier made by the Government of Pakistan for mutual legal assistance, surrendering the status of civil party, abandoning the claims to the allegedly laundered moneys lying in foreign countries, including Switzerland, which were also declared to be unauthorized and illegal communications and consequently of no legal effect. Thus, it was declared that the initial requests for mutual legal assistance for securing the status of civil party and claims launched to the allegedly laundered moneys lying in foreign countries, including Switzerland were declared never to have been withdrawn; therefore, the Federal Government and other concerned authorities were ordered to take immediate steps to seek revival of the said requests, claims and status.

4.                     Without going into the details in respect of the claims of the Government of Pakistan before the authorities of Switzerland, it would be appropriate to note that at the time of hearing of the petitions filed by Dr. Mobashir Hassan and others, with a view to ascertaining as to how many persons had benefited from section 33F of the National Accountability Ordinance, 1999 as inserted by section 7 of the NRO, 2007, the National Accountability Bureau (NAB) was asked to furnish the details of the same. After great deal of difficulty, a list was provided by the Chairman NAB, which indicated that there were two categories of beneficiaries, namely, the holders of public office whose cases were pending inside and outside Pakistan in which US $ 60 million were involved for which a request for mutual legal assistance and civil party to proceedings had been made by the Federal Government. As far as the category of beneficiaries inside Pakistan was concerned, this Court, in exercise of powers under Article 187 read with Article 190 of the Constitution directed the NAB or any other executive authority to supply requisite information. Thus, in the wake of this judgment, it was incumbent upon the Federal Government to implement the order of this Court, particularly with reference to revival of the proceedings outside the country, details whereof have been mentioned in Para 178 of the judgment (supra). We may observe here that this aspect of the case was not contested. Subsequent thereto, review petition was also filed against this judgment by the Federation through its counsel, which was dismissed on 25.11.2011. In the meanwhile, on different occasions, mentioning of the details whereof may not be necessary at this stage, the Federal Government and the Prime Minister being the Chief Executive were asked to implement the order, but the same was not done. Consequently, after dismissal of the review petition, again a 5-member Bench was constituted to ensure implementation of the order, inter alia, in respect of non-compliance of the direction of the Court for the revival of the proceedings outside the country by writing a letter, which could only be possible under the Rules of Business by the Federal Government through the Chief Executive, but reluctance was shown. Ultimately, the Bench seized with the matter passed the order on 10.01.2012 identifying six options available to the Court, details of which find mention in the order, copy of which has been filed along with the appeal, and observed that on account of constitutional importance of the matter, request was sent to the Chief Justice to consider the desirability of its hearing by a larger Bench on the next date of hearing. Accordingly, the learned      7-member Bench so constituted passed order on 16.01.2012, relevant Para therefrom is reproduced hereinbelow:-

“4.        In the circumstances, we are left with no option but in the first instance to issue show cause notice to Mr. Yousaf Raza Gillani, the Prime Minister of Pakistan, under section 17 of the Ordinance V of 2003, read with Article 204 of the Constitution of Islamic Republic of Pakistan, 1973, as to why he shall not be proceeded against for contempt of Court for not complying the directions of this Court. He shall, in accordance with Section 17 of the Ordinance, personally appear before the Court on the next date of hearing.”

In the wake of said order, a show cause notice was issued within the contemplation of section 17(1) of the Ordinance, 2003. Surprisingly, no reply was filed to the show cause notice, but the learned Bench, after providing opportunity of preliminary hearing, admittedly for almost two days, passed order on 02.02.2012, which has been challenged in the instant appeal.

5.                     We have heard the arguments of the learned counsel at length and have gone through the relevant documents and the case law wherein he has mainly raised following two points: -

(a)               Sufficient opportunity was not provided to the appellant through his counsel to put up his case before the Bench; and

(b)               The order has been passed without assigning any reason.

6.                     We have concluded, for the reasons to be recorded later, that the impugned order has been passed strictly in accordance with the provisions of section 17(1) and (3) of the Ordinance 2003 following the settled principles of the criminal administration of justice, therefore, no interference is called for. Consequently, the appeal is dismissed.”.

SC ordered PM Gilani to appear on feb 13 in contempt case

The seven-member larger bench of the Supreme Court (SC) hearing Prime Minister Gilani’s contempt case has indicted the prime minister and ordered him to appear on February 13, Geo News reported Thursday.

Judge Nasir-ul-Mulk said there were grounds to proceed against Gilani, despite the government’s insistence that President Asif Ali Zardari has immunity from prosecution while he is head of state.

“After the preliminary hearing, we are satisfied that prima facie there is a case for further proceeding into the matter.

“Adjourned for February 13, for framing charges. The Prime minister is required to remain present in the court,” Mulk said, reading out the order.

The SC issued the order after defence counsel barrister Aitzaz Ahsan concluded his arguments.

The Supreme Court will indict PM Gilani when he appears before the court on February 13.

Speaking to the media outside the apex court, Ahsan said that the government could file an appeal in the case.

The bench comprising Justice Nasirul Mulk, Justice Asif Saeed Khan Khosa, Justice Sarmad Jalal Osmani, Justice Ejaz Afzal Khan, Justice Ijaz Ahmed Chaudhry, Justice Gulzar Ahmed and Justice Athar Saeed is hearing the show cause notice served upon the Prime Minister in National Reconciliation Ordinance (NRO) implementation issue. Arfa Karim Randhawa Passes away in Lahore

World Youngest Microsoft Professional Arfa Karim Randhawa Passed away in Lahore. She got Microsoft Certificate at the age of 9 years.

Arfa Karim Randhawa (born 1995), in Jatt Randhawa family is a student from Faisalabad in Pakistan, who in 2004 at the age of 9 years, became the youngest Microsoft Certified Professionals (MCPs) in the world, a title she kept until 2008. She was invited by Bill Gates to visit the Microsoft Headquarters in USA. The vice president of the Software Development Division Mr. S. Somasegar wrote about it in his blog.
On returning to Pakistan, Arfa had numerous interviews on almost all of the country’s known television channels and newspapers. In August 2005, Arfa Karim received the Fatimah Jinnah Gold Medal in the field of Science and Technology, presented by the Prime Minister of Pakistan at that time. She also received the Salaam Pakistan Youth Award again in August 2005 by the President of Pakistan. Arfa Karim is also the recipient of the President’s Award for Pride of Performance. This is a very high level civil award granted to people who have shown excellence in their respective fields over a long period of time. Arfa is till now the youngest recipient of that award ever.
Arfa Karim has also represented Pakistan on various international forums, she was invited by the IT Professionals of Dubai for a stay of two weeks in Dubai. A dinner reception was hosted for her there, which was attended by the diagnostics of Dubai including the Ambassador of Pakistan. During that trip, Arfa was presented with various medals and awards. She also flew a plane in a flying club in Dubai at the age of 10, and received the first flight certificate.
In November 2006, Arfa was invited by Microsoft to be a part of the keynote session in the Tech-Ed Developers conference held in Barcelona. The theme of the conference was “Get ahead of the game” and Arfa was presented as a true specimen of being ahead of the game. She was the only Pakistani among over 5000 developers in that conference.

As of 2011, at the age of 16, Arfa Karim is studying at Lahore Grammar School Paragon Campus in her second year of A Levels. She suffered from a heart attack after an epileptic seizure on December 22, 2011 and was admitted to a hospital in critical condition. Rumours were being spread of her death on December 31, 2011.
